1. Who I am
liquidcolors is the web design service operated under the TÎRSAN brand by Cristian Tîrsan, from Brașov, Romania. You can reach me at hello@liquidcolors.ro and by phone at 0745 159 149. Full identification details: Tîrsan Cristian Ionuț Întreprindere Individuală, CUI 24162549, ONRC no. F08/798/2008, with its registered office at Str. Valea Tei nr. 39, Mun. Brașov, jud. Brașov, 500108.
2. What I offer
I build presentation websites for small businesses and entrepreneurs. I start from two packages, Essential and Complete, which you fill out in the configurator, section by section. Besides the site, I offer copywriting, SEO, DOOH advertising and design for social media. I write the code by hand, starting from my own library of blocks: sections with different types of components and content.
3. Prices
Prices are shown in euros and start from 199 EUR for the one-page package. "From" means the package is the starting point: in the configurator you add only the sections you need, each at 49 EUR, while a new page starts from 59 EUR and includes one section. You see the estimated total before you send the request. The displayed price covers what is included in the package; any addition changes both the price and the delivery time. If we agreed on a certain type of section on a page and I implemented it as such, and during the revision round you change your mind and want different content in that section, the change is treated as a new section and charged as such, at 49 EUR.
I am not registered for VAT purposes, so the prices are final, with no VAT to add. The displayed or estimated price stays valid until these terms are changed. As long as we have not agreed on a brief and you have not paid the advance, an estimate creates no obligations for you or for me.
4. Order and brief
I start from a request sent through the configurator, through the consultation form or directly by email. Together we set the type of site, the number of pages and sections, then we agree on a brief. The agreed brief is the reference I deliver against: everything in it I do, while anything extra is handled separately, as an addition.
5. Payment
I work with payment in two instalments. You pay a 50% advance after we set the type of site and the number of pages or sections; that is when I start the work. The remaining 50% is paid before launch. Hosting renewal after the first year is invoiced separately, at the time it is due.
The 50% advance is non-refundable: it covers the work already started and the slot reserved in the schedule. Amounts not paid by the due date (5 working days from the invoice) incur a penalty of 0.5% per day of delay, and the site stays unlaunched and my property until paid in full.
6. Delivery times
The standard time is 3 working days for Essential and 5 working days for Complete, applied in line with point 7 of the Terms and conditions. The time runs from the moment I have the complete content and only while the ball is in my court. If I am waiting on texts, photos or answers from you, the time stops until I receive them. Any added page or section increases both the price and the time.
7. The content you provide
You provide the texts, photos and video. If you do not have them, I can generate them for you at a cost, which also increases the delivery time. The structure of the site depends directly on the content, so I start when I have it in full. You are responsible for the right to use the materials you give me and that they do not infringe anyone else's rights.
8. Revisions and changes
Each package includes a set of revision rounds: Essential one round, Complete two rounds. A round means you send me, in a single set, all your adjustments to what I delivered.
A revision means adjusting what I delivered, within the limits of the agreed brief (texts, colors, spacing, positions), not redesigning the site and not new content.
Two situations do not use up the included rounds:
- Corrections. If something does not match the agreed brief (an agreed section is missing, I put in content other than what I received, something is broken), I fix it for free, no matter how many rounds you have used. It is not a revision, it is a correction on my part.
- New content on an already agreed section. If we agreed on a type of section and I implemented it as such, and you change your mind and want different content in that section, it is treated as a new section, at 49 EUR (see point 3).
Other adjustments beyond the included rounds or outside the brief, which do not qualify as a section, are charged at 59 EUR per hour.
9. Acceptance and sign-off
After the included revision rounds, I present the final version of the site. From that moment you have 5 working days to do one of two things:
- accept it, or
- point out to me specifically what does not match the agreed brief.
What does not match the brief I fix, then I present the final version again. New ideas or changes of taste on something that already follows the brief do not hold up acceptance: they are treated as extra work, paid for.
The site is considered accepted when any of the following happens:
- you confirm acceptance to me in writing, or
- 5 working days pass from the presentation of the final version without you pointing out specific departures from the brief.
Any change requested after acceptance falls under extra work or maintenance (see point 8 and point 15).
10. Cancellation and abandonment
If, after I have started, you give up on the project, the 50% advance is non-refundable: it covers the work already started.
If you stay unresponsive for more than 30 days while I am waiting on content, feedback or approval from you, I consider the project abandoned and close it. The advance stays retained, and resuming later is renegotiated, depending on what can still be used.
11. Hosting
Free hosting in the first year is included only if you choose to host the site with liquidcolors. If you already have hosting or prefer to keep the site elsewhere, you can: I hand over the site ready to upload. The package price stays the same, however, because the included hosting is not deducted from it. A site I build runs the same on any normal hosting. Once it leaves my server, however, I am no longer responsible for it: whatever breaks through a wrong configuration, a server update or someone else's intervention stays with you or with the provider you moved it to. I hand it over working, checked on my end; what happens to it afterwards, in an environment I do not control, is no longer on me.
If you choose to stay with liquidcolors, hosting comes with a minimum three-year contract: the first year is included in the package, and from the second year you pay in advance, for one year or several at once, from 3 EUR per month.
I handle the server's technical administration myself. On the Essential and Complete packages you receive neither FTP access nor cPanel (the hosting control panel): the server stays in my care, so it can be configured, secured and kept up to date as one whole, without the risk of a change that takes the site offline. Direct technical access is possible only in the Pro tier, and there only as needed, when the project genuinely calls for it (for example an app or a feature you maintain separately); in that case we settle the kind of access and its limits on a case-by-case basis. The site stays yours (see point 12) and regular backups are made (daily, for the last few days). The backups are a safety net, not a guarantee; I recommend you keep a copy of the important content yourself. On request, or when you move to another provider, I hand over the site in a ready-to-upload format.
"Unlimited traffic" refers to the normal traffic of a presentation site, with the content published at delivery. The hosting runs on the infrastructure of a specialised provider and is also subject to its usage rules, which I carry over into these terms. In short, the hosting account cannot be used for:
- illegal content or content that infringes copyright: pirated software, warez, cracks, protected material used without the right to do so;
- hosting or distributing files as an end in itself: collections of mp3s, videos or archives put up for download, torrent trackers, file-sharing;
- adult content (pornography, sex shops) or other content prohibited by law;
- sending unsolicited bulk email (spam) or software that does so;
- any use that loads the server artificially: mass storage, streaming, automated tasks or automatically generated traffic, beyond the reasonable resources of a presentation site.
A video or audio file of your own, embedded naturally in a page, is normal site content. What is not allowed is turning the hosting into a file depot or a streaming/download service. If a use like that comes up or the account constantly exceeds its allocated resources, I can ask for it to be corrected and, if it is not, suspend or cancel the hosting.
Before the hosting period expires I let you know in good time: one month, one week and one day ahead. Payment has a due date of 5 working days from expiry. After the due date there is a 15-day grace period in which the site stays online; if payment has still not come in by then, the site is suspended (goes offline), and after another 30 days it can be permanently deleted.
12. Rights over the site
After full payment, the delivered site belongs to you: you use it, move it or modify it however you want. The library of blocks and components I build from, together with my working methods and tools, stay with liquidcolors and I can reuse them on other projects. The materials you give me (texts, photos, logo) stay yours.
13. The liquidcolors signature
Sites made through the Essential and Complete packages keep a discreet signature in the footer: "Site by liquidcolors".
14. Portfolio
I may feature the delivered site in my portfolio and in promotional materials, with the project name and a link to it. If you do not want that, you tell me in writing and I do not include it.
15. After launch
Launch is not the end. I stay within reach for adjustments, questions and the next steps. Ongoing maintenance, later changes and new services are set separately, depending on what you need.
16. Liability
I deliver the site according to the agreed brief and I keep to the timelines I commit to, as long as I have what I need from you. I make sites indexable and fast, following good practice, but I do not guarantee a particular position in Google or a particular business result, because those also depend on factors outside my control.
The site is built for modern browsers, in the latest two major versions of Chrome, Firefox, Safari and Edge. On older or exotic browsers, outside this range, the display may differ.
Some features may depend on third-party platforms (for example bookings, payments, maps, newsletter). The availability, rules and costs of these platforms are set by them; I am not responsible for their changes, outages or fees.
I am not responsible for the content you give me, nor for outages caused by third-party services (for example hosting or domain providers).
17. Force majeure
For planned holidays I do not start projects I cannot deliver on time, and I notify clients already under contract in advance.
For unforeseen events outside my control (illness, temporary incapacity, major technical failures), the timelines are suspended for the duration of the event and I let you know as soon as I can. If the situation lasts more than 30 days, either of us can postpone or end the project: I hand over what is ready by then, and the part of the price not covered by work is settled fairly.
18. Personal data
The data you leave with me through forms (name, email, phone, project details) I use only to contact you and to see the project through. I do not sell it and do not pass it on for marketing purposes. The full details about data processing and your rights under the GDPR are in the privacy policy.
19. Changes to the terms
I may update these terms when the services or prices change. The version published on this page, with the date at the top, is the one in force. For projects already started, the terms agreed at the time of the order remain valid.
20. Governing law
These terms are governed by Romanian law. If a disagreement arises, I first try to resolve it directly, amicably. If we do not succeed, the courts at my registered office in Brașov have jurisdiction.
